10. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware, and you agree to submit to the personal jurisdiction of such courts.

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim against us, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or we may bring a formal proceeding.

11.2 Arbitration

Any dispute arising from these Terms or your use of the Site that cannot be resolved through informal dispute resolution shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in the English language and shall take place in Delaware.

11.3 Class Action Waiver

YOU AND SAVINGSRADAR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Severability and Waiver
